Terms of Service

1. Acceptance of Terms

By accessing or using Volio, you agree to these Terms of Service. If you do not agree with any part, you must not use the platform. These terms constitute a binding agreement between you and the operator of Volio.

2. Service Description

Volio is an online platform that allows users to create, edit, publish and share interactive digital albums in 3D book format. Users can design pages in a visual editor, add images, videos and audio, and publish their albums as immersive experiences accessible via a link. The platform also offers a community template gallery.

3. Eligibility

  • Be at least 13 years of age.
  • Have the legal capacity to accept these terms.
  • Not be subject to international sanctions or reside in countries with export restrictions that prohibit use of the service.

4. User Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

  • Provide accurate, current and complete information during registration.
  • Maintain the security of your password and not share your account with third parties.
  • Notify us immediately of any unauthorized use of your account.
  • Each account must correspond to a natural person. Creating multiple accounts is not permitted.

5. Intellectual Property and User Content

You retain all intellectual property rights to the content you upload and create on Volio (images, videos, audio, text and albums). We do not claim ownership of your content.

By using Volio, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, reproduce and display your content solely for the purpose of providing the service to you. This license ends when you delete your content or cancel your account, subject to the 90-day retention period.

If you mark an album as public, anyone with the link can view it. Volio may contact you to request permission before using a public album as an example or promotional material. We will never use your content without your explicit authorization.

If you publish an album as a template in the community gallery, other users may create copies of that template for their own albums. Templates are subject to an approval process.

6. Acceptable Use

You agree not to use Volio for:

  • Illegal activities or any violation of applicable law.
  • Posting illegal, obscene, defamatory, threatening, violent content or content that infringes third-party rights.
  • Uploading content that infringes copyright, trademarks, privacy or other third-party rights.
  • Attempting to harm, disable, overload or compromise the security of the platform.
  • Scraping, data mining or automated extraction of content without our authorization.

7. Payments and Billing

All payments are processed through our external payment provider (currently LemonSqueezy). Volio does not store or have access to your full credit card data. See our Privacy Policy for the current provider.

  • Displayed prices do not include taxes. Applicable taxes (VAT, GST, sales tax, etc.) are calculated and added during checkout based on the buyer's location.
  • All prices are in US dollars (USD).
  • You are responsible for any applicable taxes on your purchase, including withholding taxes.

8. Subscriptions

Volio offers free and paid plans. The features and limits of each plan are described on the pricing page:

  • The free plan has limits on storage, number of albums and pages per album. You can upgrade at any time.
  • The Premium plan requires a paid subscription with automatic monthly or annual renewal.
  • Subscriptions automatically renew at the end of each period unless cancelled before the renewal date.
  • You can cancel your subscription at any time from your billing section. Cancellation takes effect at the end of the current billing period.
  • Upon cancellation or non-renewal, your account will be downgraded to the free plan and access to Premium features and content exceeding free plan limits will be restricted (view-only mode).
  • We reserve the right to modify plan prices with 30 days' prior notice. Changes will not affect the current billing period.

9. Refunds

We offer a 14-business-day refund period from the date of subscription purchase, in accordance with our Refund Policy. See the specific policy for details.

10. Cancellation and Termination

You may request account cancellation at any time by emailing thesantiagorex@gmail.com. After cancellation, your data will be retained for a 90-day grace period before deletion.

We may suspend or terminate your account if you violate these terms, if your conduct poses a legal or security risk to the platform or third parties, or if you fail to meet payment obligations.

Upon termination, you will lose access to all albums and content. We recommend manually downloading your content before requesting cancellation.

11. Limitation of Liability

Volio is provided 'as is' and 'as available'. To the maximum extent permitted by law, the operator of Volio shall not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the service. Our total liability shall not exceed the amount paid by you during the 12 months preceding the claim.

12. Disclaimer

We do not guarantee that the platform is error-free, uninterrupted, virus-free or completely secure. The service may be temporarily suspended for maintenance or for reasons beyond our control. We are not responsible for data loss; we recommend keeping backups of your content.

13. Governing Law

These terms are governed by the laws of the Republic of Colombia. Any dispute relating to these terms shall be submitted to the competent courts of Colombia.

14. Dispute Resolution

Before initiating any legal action, both parties agree to attempt informal resolution by contacting thesantiagorex@gmail.com. If the dispute is not resolved within 30 days, either party may pursue legal action in Colombian courts. For users in the European Union, the European Commission offers an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

15. Modifications to Terms

We may modify these terms at any time. We will notify you of material changes through the platform or by email at least 15 days in advance. Continued use of the service after the effective date constitutes acceptance of the new terms. As Volio constantly evolves, some features described in these terms may be incorporated, modified or removed; any material change will be notified.
